TALLAHASSEE, Fla. – Gov. Ron DeSantis on Thursday signed laws that may enhance penalties for individuals who flee or try and elude regulation enforcement, particularly for repeat offenders.
What it does: HB 113 will increase the minimal penalties for fleeing and eluding regulation enforcement and imposes harsher punishment for repeat offenders by reclassifying these offenses on the state’s Felony Punishment Code’s severity chart.
- Underneath the invoice, fleeing or trying to elude with excessive pace or “wanton disregard” for security strikes from a Degree 4 to a Degree 5 offense.
- Aggravated fleeing or trying to elude involving a crash and harm/injury strikes from a Degree 5 to a Degree 6 offense.
- If the first offense is fleeing or aggravated fleeing, and the offender has a previous conviction for a similar, their subtotal sentencing factors shall be multiplied by 1.5.
